European community regulation on ozone depleting substances and related Italian legislation.

Summary

On 28th December 1993, Italy has adopted Law n. 549 “Measures to protect stratospheric ozone layer and environment”, as amended by Law n. 179, 16 June 1997, to establish the terms for ending the use of substances depleting the ozone layer and damaging the environment and to deal with phases of collection, recycling and disposal of such substances. In particular, the Law regulates the production, consumption, import, export, detention, collection, recycling and trade of all controlled substances under the former European Regulation (EEC) n. 594/91. The European Union and its Member States are still at the forefront of ozone layer protection with a policy that often goes beyond the requirements of the Montreal Protocol. In order to update their obligations under the Montreal Protocol, the EU has adopted in 2000 Regulation (EC) n. 2037/2000 on ODSs, now replaced by Regulation (EC) n. 1005/2009. The provisions of this Regulation are directly applicable in each Member States.
