Summary
Points out that for the property manager the absence of definitive guidance and specific regulation with respect to sick buildings can be particularly worrying. There are no rules to follow, and no officially-recognised measures to take which can secure the building and its occupants against this form of ill health. Current UK legislation does not address this type of indoor environmental problem and establishing where liability lies is not an easy task. States that the threat of litigation is a real one, and law suits have already been brought in the USA for damages against numerous parties involved in the design, construction and maintenance of buildings and plant. In the absence of specific sick building syndrome rules, considers some of the existing legal principles which might be applied in a new way to sick building syndrome cases.
